Laws concerning restrictive covenants are evolving - from the FTC's final rule effectively banning all non-compete agreements between employers and "workers" to changing state laws that impose greater scrutiny on the use of restrictive covenants. So, what is the current state of the law? This webinar will address the state of the FTC's efforts (especially in light of the elimination of the Chevron deference) to restrict the use of restrictive covenants and what is expected to happen from a federal law perspective, and provide an overview of the various state laws on restrictive covenants, which can be broken down into categories. In addition, this webinar will discuss best practices with respect to what restrictive covenants to use, how to use them, and the risks and benefits of each. This webinar will also address best practices with respect to employee intake to subject employees to restrictive covenants and to protect the brokerage from hiring an employee who may be bound by a restrictive covenant. Further, this webinar will address best practices when the brokerage receives a threatening letter stating that the brokerage hired an employee who is subject to restrictive covenant and making demands on the brokerage, including, but not limited to, turning over customer lists or other data, pay damages, and fire the employee.
